My Rebuttal to Motion to Dismiss [My Case against the City]- Reply to the city’s motion (above) where I argue that the administrative review is still very much necessary as the amount and severity of the “errors” were inexplicable as simple mistakes; I request the city be reprimanded and for other further relief as the court deems appropriate.

Fined $1500 for “missing” a court appearance I was present at:
I received citations 0500085848 and 0500085849 for alleged ordinance violations at a property I own in Granite city, along with a notice to appear on January 7th, 2019. In this case, I did actually own the property I was ticketed for.
I attended the court hearing on January 7th as demanded, along with the occupants of the property, my customers, which resulted in the citations against my tenant being verbally dismissed. When I took the stand, I submitted my written statement, and was told that the matter would be settled at a future court hearing.
Soon after, I received the erroneous hearing notice (right). Dated January 8th, it declared that my presence would be necessary at a court hearing on January 7th, however, I was already present at a January 7th hearing.
I later received a default judgement for $1500, for missing a court hearing, even though I was present in front of at least four witness at my January 7th court hearing. Note: default judgement for hearing without notice have been an ongoing issue with Granite city.
On March 11th, 2019, I hand delivered a request to vacate the default judgement. To this date I have not received a response from the city. I was forced to take time off work to drive to the Madison county court house and file an official protest.
