Please see &#8220;<a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/06\/2474-Iowa-Rebuttal-to-Motion-to-Dismiss.pdf\">My Rebuttal to (City&#8217;s) Motion to Dismis<\/a>s&#8221; for more details.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Available Case Filings:<\/h5>\n\n\n\n<p><a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/06\/2474-Iowa-Rebuttal-to-Motion-to-Dismiss.pdf\">My Rebuttal to Motion to Dismiss<\/a> [<strong>My Case against the City<\/strong>]- Reply to the city&#8217;s motion (above) where I argue that the administrative review is still very much necessary as the amount and severity of the &#8220;errors&#8221; were inexplicable as simple mistakes; I request the city be reprimanded and for other further relief as the court deems appropriate. <\/p>\n\n\n\n<p><a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/06\/2474-Iowa-Citys-motion-to-dismiss-administrative-Review.pdf\">City&#8217;s Motion to Dismiss Administrative Review<\/a> -The city&#8217;s motion to dismiss, contending that the administrative review is now moot due to the citations being dismissed.<\/p>\n\n\n\n<hr class=\"wp-block-separator is-style-wide\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Original Citations:<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Fined $1500 for &#8220;missing&#8221; a court appearance I was present at:<\/h4>\n\n\n\n<p>I received citations <a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/citation-0500085848.png\">0500085848 <\/a>and <a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/citation-0500085849.png\">0500085849 <\/a>for alleged ordinance violations at a property I own in Granite city, along with a notice to appear on January 7th, 2019. In this case, I did actually own the property I was ticketed for.<\/p>\n\n\n\n<p>I attended the court hearing on January 7th as demanded, along with the occupants of the property, my customers, which resulted in the citations against my tenant being verbally dismissed. When I took the stand, I submitted my written statement, and was told that the matter would be settled at a future court hearing.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice.png\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice-760x1024.png\" alt=\"\" class=\"wp-image-303\" width=\"387\" height=\"522\" srcset=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice-760x1024.png 760w, https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice-223x300.png 223w, https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice-768x1035.png 768w, https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice-1200x1617.png 1200w, https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice.png 1612w\" sizes=\"auto, (max-width: 387px) 85vw, 387px\" \/><\/a><figcaption>Erroneous Hearing notice<\/figcaption><\/figure><\/div>\n\n\n\n<p>Soon after, I received the <a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Erroneous-hearing-notice.png\">erroneous hearing notice (right)<\/a>. Dated January 8th, it declared that my presence would be necessary at a court hearing on January 7th, however, I was already present at a January 7th hearing.<\/p>\n\n\n\n<p>I later received a default judgement for $1500, for missing a court hearing, even though I was present in front of at least four witness at my January 7th court hearing. Note: default judgement for hearing without notice have been an ongoing issue with Granite city.<\/p>\n\n\n\n<p>On March 11th, 2019, I hand delivered a <a href=\"https:\/\/defendant378.com\/wp-content\/uploads\/2019\/03\/Motion-to-vacate-default-judgement.png\">request to vacate the default <\/a>judgement. To this date I have not received a response from the city.
